4.5. The App is a tool that supplements parental supervision. It does not replace direct parental supervision, upbringing and care, and is not an emergency service. In emergencies, the User must contact the relevant public services (internal affairs bodies, emergency medical services, emergency services).

4.6. In the event of a breach of the prohibitions set out in this Section, the Contractor is entitled to block or delete the Account without prior notice and to terminate the Agreement unilaterally. If there are reasonable grounds for suspicion, the Contractor is entitled to request from the User documents confirming his or her identity and legal relationship with the Child (identity document, birth certificate, document on guardianship or custodianship, etc.). If the documents are not provided within 3 (three) business days from the day the request is sent, the Contractor is entitled to block the Account.

5.7. The User shall keep the Account login details and Verification Codes confidential and shall not disclose them to Third Parties. All actions performed through the Account are deemed to have been performed by the User.

5.8. If the User's device is lost, or if the User discovers or suspects that Third Parties have accessed the Account, the User must notify the Contractor immediately, but no later than within 1 (one) calendar day. 6.3. Payment is deemed made at the moment the funds are confirmed by the payment system. The Subscription Period begins on the day the payment is confirmed. An electronic receipt confirming the payment is provided to the User in the manner established by law.

6.4. If the User enables automatic subscription renewal, the payment for the next Subscription Period is debited from the User's bank card on the last day of the current Subscription Period. A User who does not agree with the new price shall disable automatic renewal. Otherwise, the User is deemed to have agreed to the new price.

6.7. During a Subscription Period, the User is entitled to switch to a higher Plan. In this case, the difference between the Plan prices is calculated pro rata to the remaining days. A switch to a lower Plan takes effect from the next Subscription Period.

6.8. The User may submit an objection regarding a payment to the Contractor in writing within 30 (thirty) calendar days from the day the payment was made. If no objection is raised within this period, the payment and its amount are deemed confirmed by the User.

7.3. The Contractor's obligations do not include providing the User and the Child with Internet or mobile connectivity, supplying devices or SIM cards, or configuring software not related to the App. Internet connectivity is provided by the User at the User's own expense.

7.4. The Contractor takes all reasonable measures to ensure the uninterrupted and error-free operation of the App. However, taking into account the specific characteristics of the Internet and mobile devices, the Contractor does not guarantee 100 percent uninterrupted operation of the App.

7.5. The Contractor is entitled to temporarily suspend services for scheduled maintenance. Notice thereof is given in the App at least 24 (twenty-four) hours in advance. In emergencies, urgent works may be carried out without prior notice. The Contractor endeavours to complete such works within a short time.

7.6. The Contractor is entitled to update the App and to improve its interface and Features. In doing so, the core Features included in the Plan are retained until the end of the Subscription Period.

8. Refund procedure

8.1. The service fee is paid for the provision of the ability to use the App during the Subscription Period. Regardless of whether the User has actually used the App, the service fee is non-refundable except in the cases provided for in this Section and in clause 9.6 of the Offer.

8.2. The following circumstances do not constitute an App Malfunction. They do not entitle the User to a refund, and the Subscription Period is not extended on account of them:

a) the Child's Device being switched off, its battery running out, or the device being damaged, lost or stolen;

b) the absence or poor quality of the Internet connection on the Child's or the User's device, or interruptions in the services of the mobile operator or Internet provider;

c) the child app being removed or stopped, or its permissions being revoked, by the Child or another person;

d) the operation of the App being restricted by the device's power-saving mode, by limitations of the operating system or its updates, or by other apps (antivirus, etc.);

e) the User's or the Child's device not meeting the requirements specified in clause 7.1 of the Offer;

f) problems with the SIM card, insufficient balance with the mobile operator, or the number being blocked;

h) the User changing his or her mind, being unwilling to use the App, or not having used it;

i) the Account being blocked or deleted due to a breach of the terms of the Offer;

j) interruptions in the services of banks, payment systems and other Third Parties, or force majeure circumstances;

k) maintenance works carried out in accordance with clause 7.5 of the Offer.

8.3. The User acknowledges that, from the moment the Subscription Period begins, the ability to use the Features of the App has been provided in full and the provision of services has commenced.

8.4. Where an erroneous (duplicate) payment has been made or excess funds have been debited due to a technical error in the payment system, the overpaid amount is refunded upon the User's written request, by the same means through which the payment was made, within 10 (ten) business days from the day the request is received.

9. Remedying App Malfunctions and technical support

9.1. User requests are received by the Support Service through the following channels: the in-app "Help" section (the main channel), email and the Telegram channel specified in Section 20 of the Offer. 9.3. Upon discovering an App Malfunction, the User should notify the Contractor through the channels specified in clause 9.1. The notice shall state the nature of the malfunction, the time it occurred and the device model, and screenshots shall be attached where possible.

9.4. The Contractor confirms receipt of the malfunction notice within 1 (one) business day and investigates the cause of the malfunction. If it is confirmed that the malfunction arose for reasons attributable to the Contractor, the Contractor remedies it within 10 (ten) business days from the day the notice is received. In technically complex cases, this period may be extended to 30 (thirty) calendar days with notice to the User.

9.5. The principal consequence of an App Malfunction is its remedying by the Contractor. If, due to a malfunction, the core Feature of the Plan (location tracking) does not work continuously for more than 72 (seventy-two) hours from the moment the User gave notice, the Contractor extends the Subscription Period free of charge by the number of days during which the Feature did not work.

9.6. If the Contractor fails to remedy an App Malfunction within the maximum period established in clause 9.4, the User is entitled to terminate the Agreement and demand a refund proportionate to the unused days of the current Subscription Period. The amount is refunded within 10 (ten) business days from the day the written request is received.

9.7. The Contractor is not liable for App Malfunctions of which the User has not notified the Contractor, nor for the period preceding such notice, and the Subscription Period is not extended in respect thereof.

9.8. The following requests are not considered: requests containing insulting or obscene language; requests not related to the App (device repair, mobile operator services, etc.); and requests whose content is unintelligible or unclear.

9.9. If the answer to a question in a request is available in the App's "Frequently asked questions" section, the response may be given in the form of a link to the relevant section.

10. Blocking and deletion of the Account

10.1. Blocking of the Account means the User's temporary inability to use the Features. During the blocking period, limited access to the Account and the ability to contact the Support Service are retained.

10.2. The Contractor is entitled to block the Account in the following cases:

a) if the User breaches the terms of the Offer;

b) if the documents specified in clause 5.6 of the Offer are not provided within the established period;

c) if the User provides incorrect information or fails to update it in a timely manner;

d) upon receipt from Third Parties or competent public authorities of a substantiated complaint or request concerning a breach of clause 4.2 of the Offer – until the investigation is completed;

e) if there is reasonable suspicion of unauthorized access to the Account – in order to ensure the User's security.

10.3. The User is notified via the App or by SMS of the reason for blocking and the procedure for remedying it. The Account remains blocked until the breach is remedied. The blocking period does not extend the Subscription Period.

10.4. The Contractor is entitled to delete the Account in the following cases:

a) at the User's request;

b) if the Account has been blocked more than 3 (three) times;

c) in the event of a gross breach of clause 4.2 of the Offer, or if the User fails to remedy a breach within 3 (three) business days from the day the Contractor sends a request;
